Terms of Service
Safe Clean Sanitation (“Company,” “we,” “us,” or “our”) provides portable sanitation equipment and related services throughout the United States. By placing an order, signing a rental agreement, or using any of our services, you (“Customer,” “you,” or “your”) agree to be bound by these Terms of Service. Please read them carefully before proceeding.
Services
Safe Clean Sanitation rents portable restrooms, restroom trailers, hand wash stations, portable showers, and related sanitation equipment. All rentals are subject to availability at the time of booking. We reserve the right to substitute comparable equipment if the exact unit requested is unavailable, and we will notify you in advance whenever possible.
Service areas, delivery windows, and available unit types may vary by location. Contact us to confirm availability for your specific address before finalizing your reservation.
Reservations and Orders
A reservation is considered confirmed once we have received your order details and issued a written confirmation by email or other communication. We recommend confirming your reservation at least 72 hours before your required delivery date to allow adequate scheduling time.
We reserve the right to decline or cancel any reservation at our discretion, including reservations that cannot be safely fulfilled due to site conditions, access restrictions, or other operational constraints.
Delivery and Site Access
You are responsible for ensuring that the delivery site is accessible, level, and free of obstructions that would prevent safe placement of equipment. This includes adequate clearance for our delivery vehicles and sufficient ground clearance to set units in place without damage to surrounding property.
If our drivers are unable to access the site at the time of scheduled delivery, a failed delivery fee may apply. Any additional trip required due to site inaccessibility will be charged at our then-current rates.
You agree to notify us of any site hazards, underground utilities, or other conditions that may affect delivery or placement. Safe Clean Sanitation is not liable for damage caused by inaccurate or incomplete site information provided by the Customer.
Rental Period and Extensions
The rental period begins at the time of delivery and ends at the time of pickup. Rentals covering specific events or short-term use are based on the agreed period stated at the time of booking.
If you require an extension beyond the original rental period, you must contact us before the scheduled pickup date. Extensions are subject to availability and additional charges at our current rental rates. Failure to request an extension does not entitle you to continued use of the equipment beyond the original rental term.
Use of Equipment
You agree to use all rented equipment solely for its intended purpose – providing sanitation facilities for lawful use. The following are strictly prohibited:
- Disposal of hazardous, toxic, flammable, or prohibited materials into any unit
- Disposal of any solid waste other than human waste and standard toilet tissue
- Flushing paper towels, wipes (including those labeled “flushable”), feminine hygiene products, diapers, or any non-dissolving material
- Use of units for any illegal activity
- Unauthorized modification, relocation, or alteration of any equipment
- Use by more users or at a capacity that materially exceeds normal sanitation use
You are responsible for the equipment from the time of delivery until the time of pickup. This includes ensuring that units are not tipped, vandalized, or misused while in your care.
Customer Responsibilities
You agree to:
- Provide accurate delivery and contact information at the time of booking
- Ensure a responsible adult is available or reachable at the time of delivery and pickup
- Keep the area around each unit clear and accessible throughout the rental period
- Promptly report any damage, malfunction, or service concerns to us
- Comply with all applicable local, state, and federal regulations regarding portable sanitation
Prohibited Uses
Equipment rented from Safe Clean Sanitation may not be used in connection with any activity that violates local ordinances, health codes, or any applicable law. We reserve the right to retrieve equipment immediately, without refund, if we determine that units are being used in connection with unlawful activity or in a manner that creates a public health risk.
Damage, Loss, and Vandalism
You are financially responsible for any damage to equipment that occurs during the rental period beyond normal wear and tear. This includes, but is not limited to:
- Physical damage from impact, tipping, or improper handling
- Damage caused by prohibited materials being introduced into units
- Theft or complete loss of a unit
- Graffiti or intentional defacement
We will document the condition of equipment at delivery and pickup. In the event of damage, we will provide an itemized invoice for repair or replacement costs, which are due upon receipt.
Service and Maintenance
For rentals of one week or longer, routine service – including pumping, restocking of consumables, and cleaning – is scheduled at agreed intervals. You are responsible for notifying us if a unit requires unscheduled service due to heavy use or an overflow condition. Emergency service calls outside of scheduled visits may incur additional charges.
We are not responsible for sanitation issues arising from use that exceeds the capacity for which the unit was scheduled to be serviced.
Pricing and Payment
All prices are quoted at the time of booking and are subject to change. Fuel surcharges, environmental fees, or other applicable charges will be disclosed prior to confirmation. Taxes applicable to your location will be added where required by law.
Payment terms are as stated on your invoice or rental agreement. Invoices not paid within the stated due date may be subject to late fees. We reserve the right to withhold future service or recover equipment in the event of non-payment.
Returned checks or failed electronic payments may result in an additional processing fee.
Cancellations and Refunds
Cancellation policies are as follows:
- Cancellations made more than 48 hours before the scheduled delivery are eligible for a full refund of any deposit paid.
- Cancellations made within 48 hours of scheduled delivery may be subject to a cancellation fee.
- No refund will be issued for early termination of a rental once equipment has been delivered, except at our sole discretion.
If we cancel a confirmed reservation due to circumstances within our control, you will receive a full refund of any amounts paid.
Limitation of Liability
To the fullest extent permitted by applicable law, Safe Clean Sanitation’s total liability to you for any claim arising out of or related to our services shall not exceed the total amount paid by you for the specific rental giving rise to the claim.
We are not liable for indirect, incidental, special, or consequential damages, including but not limited to lost profits, loss of use, or third-party claims, even if we have been advised of the possibility of such damages.
We are not responsible for delays, failures, or interruptions in service caused by events beyond our reasonable control, including severe weather, road closures, natural disasters, or other force majeure events.
Indemnification
You agree to indemnify, defend, and hold harmless Safe Clean Sanitation, its officers, employees, contractors, and agents from and against any claims, damages, losses, or expenses – including reasonable attorney fees – arising out of or related to your use of our equipment or services, your breach of these Terms, or any negligent or unlawful act by you or any person using the equipment during the rental period.
Health and Safety
Portable sanitation equipment involves inherent health and hygiene considerations. You agree to follow all posted usage instructions on each unit and to ensure that users are made aware of proper use. We are not liable for illness, injury, or health consequences arising from improper use of equipment or failure to follow usage guidelines.
Privacy
Any personal information you provide to us in connection with a rental – such as your name, address, phone number, and email address – is used solely for the purpose of fulfilling your order and communicating with you. We do not sell or share your personal information with third parties for marketing purposes. For more details, please refer to our Privacy Policy.
Governing Law and Disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or our services that cannot be resolved informally will be submitted to binding arbitration in Pinal County, Arizona, in accordance with the rules of the American Arbitration Association.
Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Modifications to These Terms
We reserve the right to update these Terms of Service at any time. Updated Terms will be posted on our website at safecleansanitation.com. Continued use of our services after an update constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
Entire Agreement
These Terms, together with any written rental agreement, order confirmation, or service contract provided to you, constitute the entire agreement between you and Safe Clean Sanitation with respect to the subject matter herein and supersede all prior discussions, representations, or agreements.
